Obligation to automate buildings by the end of 2024
Non-residential buildings with a heating or air conditioning system output of more than 290 kilowatts must be equipped with a building automation system by December 31, 2024, in accordance with the GEG §71a Building Energy Act.
Continuous monitoring, logging and analysis
The building automation system must enable continuous monitoring, logging and analysis of energy consumption. A person or company must be appointed or commissioned for building energy management.
Communication and joint operation of different systems
The building automation system must enable communication between connected technical building systems and other applications within the building. It must be ensured that these systems can be operated together with other types of technical building systems
Under the (CSRD), companies around the world - which are covered by the directive - will have to report ESG data from the beginning of 2025. This ESG data will be subject to the same rigorous scrutiny by regulators as corporate financial data.

Carbon Dioxide Cost Allocation Act
The Carbon Dioxide Cost Allocation Act (CO2KostAufG) regulates the allocation of carbon dioxide costs between landlords and tenants for buildings that use fossil fuels to generate heat and hot water.
Allocation of carbon dioxide costs
The carbon dioxide costs are split between the landlord and tenant. The higher the CO2 emissions of a building, the more costs the landlord bears. For low-emission buildings, the tenant bears up to 100% of the costs, while the landlord bears up to 95% of the costs for inefficient buildings.
Reimbursement claim of the tenant
If the tenant provides their own heating or hot water, they are entitled to reimbursement of the carbon dioxide costs that the landlord must bear by law. The tenant must assert this claim within twelve months of billing.
